Who we are
FxMind (fxmind.ai) is the service described in these terms. In these terms, FxMind, we and us mean the operator of fxmind.ai.
In these terms, FxMind, we, us and our mean that company. You means the person who uses FxMind. The service means the website fxmind.ai, the web app, the mobile apps, the API and our support channels.
By creating an account, starting a trial, buying a plan or otherwise using the service, you accept these terms, the privacy policy and the risk disclosure. If you do not accept them, do not use FxMind. If you use FxMind for a company, you confirm that you may accept these terms for it, and you also means that company.
What FxMind is and what it is not
FxMind is software for forex traders. It shows market context such as the economic calendar, prices, positioning reports and headlines. It reads the trading accounts you link, keeps a trading journal, warns you when news or a prop firm rule meets your open positions, and answers questions about that data through an AI analyst.
FxMind is an analytics and risk-monitoring tool. It is not:
- investment advice. Nothing in FxMind is a personal recommendation or a suggestion to buy, sell or hold anything. We are not an investment adviser, a broker, a dealer or a portfolio manager;
- a signal service. FxMind does not tell you what to trade or when;
- account or portfolio management. We do not hold your money, manage your account or make trading decisions for you;
- a trading system. FxMind never opens a trade and never places a new order. On a guarded link it can only take the protective actions you allow, as described below.
You make every trading decision, and you are responsible for its result.
Who may use FxMind
- You must be at least 18 years old and legally able to enter a binding contract where you live.
- You may not use FxMind where the law prohibits it, or where offering it to you would break the law, including sanctions and export control laws. You confirm that you are not named on a government sanctions list and do not live in a country or region under a comprehensive embargo.
- You are responsible for following the laws that apply where you live to your trading and to your use of software like FxMind.
- We may refuse to open an account, or limit access, in some countries.
Your account and its security
- Give accurate information and keep your email address current. We send security, billing and legal notices there.
- Keep your password, recovery codes, devices and API keys secret, and do not share them. You are responsible for activity under your account, unless it happened because we failed to protect the service.
- Turn on two-factor authentication (2FA). It is required to create a guarded link, change an action policy, create API keys and add affiliate payout details.
- A sign-in stays active for up to 30 days without use and up to 90 days in total. You can see your active sessions and sign any of them out in Settings. We email you when a new device signs in.
- One account is for one person. Desk team seats are the exception, and each seat is for one named person.
- If you think someone else got into your account, change your password, sign out your other sessions and write to support@fxmind.ai straight away.
We may ask you to confirm your identity, sign you out or lock the account for a short time when we see activity that looks unsafe.
Mentor access and team seats
- Mentor access. A Desk seat can be given read-only access to another Desk account's trading journal, so a mentor, coach or accountability partner can see trades and leave comments. You (the account holder) invite the mentor, you choose whether they may comment, and you can end their access at any time. A mentor cannot trade, change settings, link accounts, see billing or broker details, or use your analyst questions.
- Team seats. A Desk plan's extra seats can also be teammates who sign in as themselves to a shared view of the account, for the people and the limits your plan sets out.
- You are responsible for who you invite as a mentor or teammate and for what you allow them to see.
The demo account
We may offer a public demo account so you can see FxMind before you sign up.
- It is one shared showcase account. Everyone who opens the demo sees the same data.
- It is read-only. You cannot change settings, link or unlink accounts, or change anything else in it.
- A demo visit ends after a fixed time, currently 2 hours.
- Conversations you start with the analyst in the demo are visible only in your own demo visit, not to other visitors. They are processed like any other analyst conversation, so do not type personal information into them.
- The demo analyst has a daily limit on questions, shared by all demo visitors. Once it is reached, the analyst stops answering until the next day (UTC).
- Demo data is there to show how FxMind works. It is not advice and says nothing about your own results.
We may change, limit or remove the demo at any time. These terms apply to your use of it.
Linking a trading account
By default you link an MT5 or MT4 account with its investor password, the read-only password your broker gives you. With it, FxMind can read balances, equity, margin, open positions, pending orders and deal history. It cannot trade: your broker's server refuses any trade request made with an investor password. This is a read-only link. Accounts on other platforms can be imported from a CSV file.
When you link an account, you confirm that:
- the account is yours, or its owner has authorised you to link it;
- your broker's and prop firm's terms allow you to connect a third-party tool and to sign in from the IP addresses FxMind uses;
- the login details you give us are correct and you are allowed to share them with us.
You can remove a link at any time in Settings. When you remove it, we stop the session and delete the stored broker password.
Guarded links and guard actions
News Guard and Prop Rule Guard send warnings on every linked account. They can act on an account only if you upgrade its link to a guarded link. A guarded link is a separate, explicit authorisation. To create one, you give the account's master (trading) password, confirm a consent screen that lists what FxMind may do, pass 2FA, and set an action policy for that account.
By creating a guarded link, you authorise FxMind to send your broker, on your behalf, the instructions your action policy allows, when its conditions are met. The authorisation lasts until you change the policy, turn actions off, return to a read-only link or remove the account.
- Allowed actions. Close a position or all positions, reduce a position, move a stop loss or take profit, and cancel a pending order. Nothing else.
- Never. FxMind never opens a position, never places a new order and never adds to a position. There is no function for it.
- Your policy. You choose the triggers, the allowed actions, the mode (alert only, ask first with 60 seconds to cancel, or act immediately) and a maximum spread. If the spread is wider than your maximum when a trigger fires, the guard does not act and sends an alert instead.
- Kill switch. One tap turns off every action on an account. We may also pause actions for all users if we detect a fault.
- Records. Every action is logged with the policy in force, the request, the broker's reply and the time it took. You get a receipt.
- Plans. Guard actions are available on the plans that include them, currently Pro and above, and the Pro trial.
You remain the holder of the account and responsible for every position in it, including positions a guard closed, reduced or changed, and positions it did not act on.
Protection lock. You can put a waiting time of 3, 6, 12 or 24 hours on changes that lower your protection on an account. While the lock is on, a change that weakens it (turning a rule off, raising a limit, turning actions off, moving to a read-only link, unlinking the account, shortening or turning off the lock) is scheduled instead of applied: it waits for the time you chose, stays visible and can be cancelled by you until it applies. A change that tightens your protection applies at once.
Lockout. If you reach your daily loss limit or your maximum loss limit, or you press Lock me now, the account is locked for the time you chose. During a lockout FxMind closes open positions, cancels pending orders and closes any new position on that account, as far as your guarded link allows; changes that weaken your protection are refused; and the same broker account cannot be linked again, by you or by anyone else, until the lockout ends. A lockout cannot be ended early, by you or by our support team. You can always close positions yourself.
What warnings and guard actions cannot do
- FxMind cannot block an order. Your broker accepts or rejects your orders. FxMind learns about a trade only after the broker has accepted it, and then warns or acts. A rule can be broken before any warning or action is possible.
- Actions can be late, partial or fail. Causes include broker outages, rejections and requotes, problems with the MetaTrader platform or server, network or proxy failures, a closed market, price gaps, slippage, a spread above your maximum, trading disabled on the symbol or the account, a changed password, maintenance and faults on our side.
- Warnings can be late or not arrive. Email, push, Telegram and Discord messages depend on providers, networks and your device.
- Calendar data can be wrong. An event can be missing, moved or listed at the wrong time, so a news warning or news trigger can fire late, early or not at all.
- A protection lock is not a block at your broker. FxMind cannot stop you trading in MetaTrader or on your broker's site. A position opened during a lockout is closed after your broker has accepted it, which can cost the spread and some slippage.
- Access can be lost. If you change the master password at your broker, remove the link, or your broker blocks the session, FxMind cannot close anything. We record it and tell you.
- On a read-only link nothing is closed. The lock then holds your settings only.
- Some firms do not allow automated trading. A close sent by FxMind may count as automated. Check your firm's rules before you turn actions on.
- Pre-trade checks cover orders sent from FxMind only. Orders you place in MetaTrader or anywhere else reach your broker without being checked.
We do not guarantee that a warning or an action will happen, that it will happen on time, that it will fill at any particular price, or that it will prevent a loss or a rule breach.
Guard rules and presets
Prop Rule Guard checks your account against rules such as a daily loss limit, a maximum drawdown, lot limits, news bans and weekend holding. To save you typing, FxMind offers presets for some prop firms, account sizes and phases.
- A preset is a starting point. We collect it from the firm's public information, on the date shown with the preset. The firm does not supply, check or endorse it.
- Firms change their rules, calculate limits in different ways and may give your account rules that differ from their public pages.
- Before you rely on a preset or any rule, you must check every rule against the firm's current rules and your own account agreement, correct what differs and keep it up to date. You confirm this each time you apply a preset.
- If a rule in FxMind differs from your firm's rules or from your agreement with the firm, the firm's rules and your agreement prevail.
- Every number FxMind shows is its own calculation from your broker's data. Your firm's own dashboard decides. The two can differ, for example over commissions, swap, open positions, payouts or the time the firm's day starts again.
- You can change any rule, turn a rule off and add rules of your own. Rules you change or add are yours, and your firm's rules still apply to your account.
- Each rule can warn you or block an order in the FxMind trading desk before it is sent. A block helps you, it does not guarantee anything: only your broker can accept or reject an order.
- When you apply a preset, accept a firm's change or set your own rules, we record the date and time, the preset and its version, and the version of the text you confirmed.
To the extent the law allows, we do not guarantee that rules, presets, warnings or automatic actions are complete, correct or timely, and we are not responsible for any rule breach, failed evaluation, lost funded account, lost or refused payout, trading loss or missed profit.
Prop firm and broker names shown in FxMind belong to their owners. Showing them does not mean those companies are affiliated with FxMind or endorse it.
Other ways FxMind can act on your account
Beyond guard actions, some other features can send an instruction to your broker or fill in an order for you. Each one is off until you turn it on, and each is your own instruction, not FxMind trading for you.
- TradingView hook drafts. You can point a TradingView alert at a URL FxMind gives you. Depending on how you set the hook up, an alert can send you a notification, mark your chart, or create a draft order. A draft order waits for you to confirm it; FxMind never sends an order from a hook by itself. A hook you set to auto-fill still needs your own confirming tap before anything reaches your broker.
- One-click and scheduled orders. The trading desk lets you send an order with fewer confirmation steps, and schedule an order to fire later or at a price you choose. These only ever place an order you configured yourself, and they carry the same broker-execution risk as any other order.
- AI apps connected through MCP. If you turn this on, you can connect your own AI application (through the Model Context Protocol) to read your FxMind data and, if you allow it, place, change or close orders on your account, using an API key you create and control. You choose what the key can do, and you can pause or revoke it at any time. You are responsible for every AI application you connect and for everything it does with your key, in the same way you are responsible for anything sent from your own account. FxMind does not review what a connected AI application decides to do, does not guarantee it acts correctly, safely or at all, and does not guarantee your broker executes what it sends. This feature is off in production until we turn it on, is at your own risk, and is described further in the API access section below.
Community
FxMind lets traders create and join communities to chat and share trade setups. A community's owner and moderators are other traders, not FxMind staff, unless we say so. Setups shared in a community are the sharing trader's own trades, posted for education: they are not FxMind's advice, and FxMind does not place or manage trades for anyone through a community. Past results shown in a community do not predict future ones.
- Your content. You keep ownership of what you post in a community. You give the other members, and FxMind, a licence to display it in that community for as long as the community and your membership exist, so a chat or a setup card can be read by the people it was shared with.
- Rules and moderation. Community owners and moderators can remove a message, mute or remove a member, and report abuse to us. We can also remove content or a member that breaks these terms. Reported content can be hidden pending a decision.
- Deleted accounts. If you delete your account, your past messages and setup cards stay visible to the community you posted them in, shown as "Deleted trader" instead of your name, so the conversation around them still makes sense to the people you shared it with.
- Following a setup. If you follow another member's shared setup, FxMind opens the position on your own linked account, in your own size, only after your own tap. If you turn on automatic management for that follow, the setup owner's later changes (for example moving a stop, taking profit, or closing) are sent to your account automatically from then on, within your own guard rules, account limits and the consent you gave when you turned it on, until you turn it off. The setup owner is not FxMind, is not your broker and does not manage your account; following and automatic management are your own standing instructions, and you remain responsible for the position and its result. FxMind does not guarantee that a followed order or an automatic change reaches your broker, that it fills, or at what price.
Market data, calendar and news
Prices, economic calendar events, positioning reports and headlines come from third-party sources. They can be delayed, incomplete, revised or wrong, and a source can stop working. Prices in FxMind can differ from your broker's prices. Your broker's prices are the ones your orders fill at.
Figures such as the usual move after a release are calculated from past data. They describe the past and do not predict the next release. Headlines link to their publisher, and we do not republish articles.
Market data in FxMind is for your own use. You may not copy, redistribute or resell it.
The AI analyst
- Answers, briefs and trade reviews are generated by AI models from our data and your account data. The analyst is instructed to cite a source for every fact, but it can still be wrong, incomplete or out of date, or misread a source.
- Open the source and verify anything that matters before you act on it. Do not use an answer as the only basis for a trading decision.
- The analyst gives no advice and no recommendations. If an answer seems to suggest a trade, treat it as an error and do not rely on it.
- Each message you send to the analyst counts as one question. Each plan includes a set number of questions per calendar month, shown on the pricing page. Monthly questions reset on the 1st and do not carry over.
- The first reply in support chat may come from an AI assistant. You can ask for a person at any time. The support assistant never acts on your account. If we reply to a chat or a ticket and you do not answer within 48 hours, we close it; write to us again at any time to reopen it.
- If you ask the analyst to change your journal, for example adding tags to a set of trades or writing a note on several of them, it never writes on its own: you see every planned change first, only your own tap applies it, and you can undo an applied change for 7 days.
- A support conversation may be machine-translated for you or for the person answering it. A translation is generated by an AI model and can be wrong; the original text is kept and decides in case of doubt.
AI trade ideas
If you turn on trade ideas in the analyst, FxMind's AI may show you trade ideas on forex pairs, gold and other precious metals, crypto pairs and indices: a direction, an entry zone, a stop, targets and the reasons, worked out by software from market data and your own journal.
Trade ideas are general information produced automatically. They are not financial, investment or trading advice, not a recommendation to buy or sell, and not personalised to your circumstances. Every idea can lose money, including more than you expect when prices gap or orders fill at worse prices. Past results, including the ideas scorecard, do not predict future results.
You decide whether to trade and you are solely responsible for every order you place and its result. FxMind never places an order from an idea: "Open in ticket" only fills in a draft that you review, size and send yourself. FxMind does not guarantee that an idea, its data or its sources are complete, current or correct, and is not liable for any loss arising from an idea or from acting on one.
Trade ideas are off by default, you can turn them off again at any time, and they may not be available in every country.

- Question pack
- 250 analyst questions for $14, or 1,000 for $45, paid once
- Prices. Prices are in US dollars, or in Brazilian reais for customers in Brazil. The pricing page lists what each plan includes. The plan and price shown at checkout are the ones that apply to your purchase.
- Taxes. Prices do not include taxes unless we say so. We add VAT, GST, sales tax or similar taxes where the law requires, and show them at checkout.
- Billing cycles. Plans are billed in advance, monthly or yearly, from the day you buy.
- Payment method. Card payment is the only payment method. Card payments are processed by Stripe, and a subscription renews automatically at the end of each period, at the price in force for that renewal, until you cancel.
- Add-ons. Add-ons are available on Trader, Pro and above. They are billed on the same cycle as your plan and end when the plan ends. A challenge account slot covers one linked account at a time, and you may move it to another account when a challenge ends.
- Question caps and packs. Each plan has a monthly cap on analyst questions. When you reach it, the analyst stops answering until the next month. On Trader, Pro and above you can buy a question pack to continue. Pack questions are used after the monthly ones run out, and they stay available until used.
- Price changes. We tell you by email at least 30 days before a price change affects you. The new price applies from your first renewal after that notice period. If you do not accept it, cancel before that renewal.
- Failed payments. If a card renewal fails, we retry and email you. You have a 7-day grace period. After it, features switch off in order, summaries first and guards last, and the account moves to Free. A Dedicated IP stays on during those 7 days. When the add-on or the plan ends, your accounts connect from FxMind's own server address and we keep the address for you for 10 days before it is released.
The free trial
- A new account can get one free 14-day trial of Pro. No card is required, and nothing is charged unless you complete a checkout.
- The trial starts when you confirm your email address, through the confirmation link, a sign-in link or a password reset link. It ends 14 days later.
- During the trial you get Pro features with 100 analyst questions.
- When the trial ends, you choose a plan or the account moves to Free. Your data stays.
- One trial per person. Each person may have one trial, ever. To keep it fair, we check automatically for repeated or abusive use: an email address that already had a trial, including variations of the same address; disposable email addresses; a browser or device that already started a trial; too many trials from the same network in a short time. An MT5 or MT4 account linked during another person's trial in the last 12 months cannot be linked during a trial.
- We may refuse a trial, or end one early, where we detect repeated or abusive use. A refused trial does not stop you from using Free or buying a plan. If you think we got it wrong, write to support and a person will review it.
The privacy policy explains the data behind these checks and how long we keep it.
Cancellation and refunds
This section is the refund policy for every purchase on FxMind.
- No refunds. FxMind does not refund payments, including the first one. Instead, a new account can try Pro free for 14 days before paying (see the free trial section above).
- Cancel any time. Cancel in Settings. Cancellation stops the next renewal. You keep your plan until the end of the period you paid for, and then the account moves to Free.
- No refunds for partial periods. We do not refund or credit the unused part of a billing period, including when you cancel, downgrade, stop using the service, or leave questions or add-ons unused.
- Yearly plans. A cancelled yearly plan ends at the end of its year. The remaining months are not refunded.
- Add-ons. Add-ons follow the period of your plan. A removed add-on stops at the end of the current period, without a refund for the rest of it.
- Question packs. A question pack is a one-off purchase and is not refunded.
- Your rights under the law. Nothing in this section limits the mandatory consumer rights you have under the law that applies to you, such as a statutory right of withdrawal or your rights when a service is not provided as agreed.
- If we end or reduce the service. If we close your account without a breach of these terms on your part, stop offering a plan you have paid for, or make a change that materially reduces it and you cancel because of that change, we refund the unused part of the prepaid period.
A refund that is due goes back to the card that paid. If you dispute a charge with your bank instead of contacting us, we may suspend the account while the dispute is open.
Acceptable use
You agree not to:
- copy, decompile or reverse engineer the service, or try to extract its source code, models or prompts, except where the law allows it;
- scrape, crawl or bulk export FxMind, or resell, redistribute or republish its data, prices, briefs or analyst answers;
- get more than one free trial, for example with several accounts, disposable email addresses, or by switching browsers, devices or networks;
- share your account or login, or sell or rent access to it;
- use scripts, bots or other automation to send questions to the analyst, try to make it ignore its instructions, or use it for work unrelated to your own trading;
- get around plan limits, rate limits or security controls, or probe, scan or overload the service;
- link a trading account you are not authorised to link;
- present FxMind output to other people as investment advice or trade signals;
- use FxMind for anything illegal, including fraud, market manipulation, money laundering or breaking sanctions, or to break your broker's or prop firm's terms;
- upload malware, or content you have no right to share.
If you find a security problem, report it to support@fxmind.ai and do not use it beyond what is needed to show it.
API access
- API access is included in Desk. It is for your own use and the use of your team seats.
- API keys are secret. Keep them out of code and files you share, rotate a key you think was exposed, and revoke keys you no longer use. You are responsible for everything done with your keys. Creating a key requires 2FA.
- Stay within the rate limits and quotas we set. We may slow, limit or block requests that exceed them or that harm the service or other users.
- Do not use the API to build a service that competes with FxMind or redistributes its data.
- We may change the API. We give notice before a change that breaks existing use, where we reasonably can.
- MCP and trading through an API key. A key you allow to trade is a standing instruction to act on your account through your own connected AI application, exactly as described in "Other ways FxMind can act on your account" above. Keep such a key especially secret, review what it is allowed to do, and revoke it the moment you no longer trust the application holding it.
Affiliate and referral program
Every account has a referral link. Creators, educators and other partners can join the partner program by invitation or application. The affiliate terms set out the full commission, attribution and payout rules and apply in addition to these terms; the program terms on the affiliates page and a signed partner agreement prevail for that partner where they differ.
- Referral program. You earn 20% of each paid invoice of a customer you referred, after discounts and taxes, for 12 months. Where your program offers a free month for each referred customer who pays instead, that reward applies.
- Partner program. Rates, duration, tracking period and coupons are set by agreement.
- Holding period. Each commission is held for 30 days after the invoice is paid. A refund or chargeback cancels it, and a commission already paid is deducted from the next payout.
- Payouts. You can ask for a payout once your approved balance is $50 or more. Payouts are made in USDT on the TRC-20 or ERC-20 network, to a wallet you confirm by email; adding or changing it requires 2FA.
- Fair promotion. Say clearly that you earn a commission. Do not promise profits, do not call FxMind a signal service or advice, do not send spam or run misleading ads, and do not advertise FxMind for futures trading or any market FxMind does not offer.
- Void commissions. Self-referrals, fake or duplicate accounts, fraud and breaches of the program rules void the commissions involved, and we may remove the affiliate from the program.
- Taxes. You are responsible for taxes on what you earn. We may ask for tax forms before paying.
- Affiliates are independent. They do not act for FxMind and cannot make promises on our behalf.
Your data and content
You own the content you add to FxMind: journal notes, tags, playbooks, screenshots, questions and imported trades. You give us a non-exclusive, worldwide licence to host, copy, process and display it only to run and secure the service for you. That includes sending the parts needed to answer a question to our AI model providers, as the privacy policy explains.
You confirm that you have the right to add that content and that it does not break the law or anyone else's rights. You can export or delete your content in Settings. The licence ends when the content or your account is deleted, except for copies the law makes us keep and backups that expire on schedule.
We may create statistics from data across users that do not identify you or your accounts, and use them to run and improve FxMind.
Intellectual property and licence
FxMind, including its software, design, briefs, statistics, presets, documentation and brand, belongs to us or our licensors. These terms do not transfer any of it to you.
While you follow these terms, we give you a personal, limited, non-exclusive, non-transferable and revocable licence to use the service for your own trading analysis, within the limits of your plan. You may share your own journal through the sharing features FxMind provides.
If you send us ideas or feedback, we may use them without any obligation to you.
Third-party services
FxMind works with services run by others, such as your broker and the MetaTrader platform, prop firms, payment providers, sign-in with Google or Apple, Telegram, Discord, AI model providers and data providers. Their own terms apply to your use of them. We are not responsible for their services, their availability or their decisions, for example a broker rejecting an order or a firm refusing a payout.
MetaTrader 4 and MetaTrader 5 are trademarks of MetaQuotes Ltd. FxMind is not affiliated with MetaQuotes, or with any broker or prop firm, unless we say so.
White-label sites. If you sign up on a site with a different name and look that runs on FxMind (for example a prop firm's or an introducing broker's own site), FxMind is still the company providing the service behind it, these terms and the privacy policy still apply, and FxMind, not the site's owner, is the data controller described in the privacy policy. The site's own owner may add its own rules for its own brand on top of these terms.
Suspension and termination
You can stop using FxMind at any time, and delete your account in Settings. After you ask for deletion, you have 7 days to cancel it. Then the account is closed and your data is erased as the privacy policy describes. Deleting the account stops renewals. Refunds follow the section on cancellation and refunds.
We may suspend or close your account, or part of the service for you, if:
- you break these terms or the program terms, or we reasonably suspect fraud or abuse;
- a payment is still overdue after the grace period, or a charge is disputed;
- your use puts other users, your linked accounts or the service at risk;
- the law, a court or an authority requires it.
We give notice and a chance to fix the problem when we reasonably can. In serious cases, or where the law or security requires it, we act immediately.
When an account closes, guard actions stop, trading accounts are unlinked and stored broker passwords are deleted. Provisions that by their nature should continue, such as payment obligations, your data and content, intellectual property, disclaimers, limitation of liability, indemnity and governing law, continue after termination.
Disclaimers
The service is provided as is and as available. To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
We do not warrant that the service will be uninterrupted, error-free or secure at all times, that data, analyst answers, warnings or guard actions will be accurate, complete or timely, or that FxMind will help you make money, avoid losses, pass an evaluation or keep a funded account.
Some countries do not allow these exclusions. Where they do not, the exclusions apply only as far as the law permits.
Limitation of liability
To the extent the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive losses;
- we are not liable for trading losses, lost or missed profits, failed evaluations, lost funded accounts, lost or refused payouts, challenge fees, loss of data or loss of goodwill, including where they result from a warning, guard action, preset, data or answer that was missing, late or wrong;
- our total liability for all claims relating to FxMind or these terms is limited to the fees you paid us in the 12 months before the event that gave rise to the claim.
Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.
Indemnity
To the extent the law allows, you will compensate us, and our directors, staff and contractors, for third-party claims, and the related losses and reasonable costs, arising from your breach of these terms, your misuse of the service, your content, or your breach of the law or of anyone's rights, including your broker's or prop firm's terms. This does not apply to the extent a claim was caused by us.
Availability and changes to the service
We work to keep FxMind available, but we do not promise any level of uptime. Maintenance, faults, broker outages, proxy failures and problems with third-party data can interrupt the service. We announce planned maintenance when we can.
We may add, change or remove features. If a change materially reduces a paid plan during a period you have already paid for, we tell you in advance, and the section on cancellation and refunds applies.
Changes to these terms
We may update these terms. The dates at the top show the current version. For a material change, we tell you by email or in the app at least 30 days before it takes effect. Changes required by law or needed for security can take effect sooner. If you keep using FxMind after a change takes effect, the new terms apply. If you do not agree, cancel and stop using FxMind before that date.
Governing law and disputes
If you have a dispute with us, write to support@fxmind.ai first. We read every message and try to settle it without going to court.
If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts the law allows you to use. For example, consumers in the European Union and the United Kingdom may bring claims in the courts where they live, and consumers in Brazil may bring claims in the courts of their domicile under the Consumer Protection Code (Código de Defesa do Consumidor).
Before starting a formal dispute, please write to support@fxmind.ai so we can try to resolve it first.
General
- These terms, the privacy policy, the risk disclosure and any terms shown when you buy a plan or join a program are the whole agreement between you and us about FxMind.
- If a court finds part of these terms invalid, the rest stays in force.
- If we do not enforce a right straight away, we do not give it up.
- You may not transfer your rights under these terms without our consent. We may transfer ours to a company that takes over FxMind, and we will tell you if that happens. Your rights under the law stay the same.
- We are not responsible for delays or failures caused by events outside our reasonable control, such as outages of internet, hosting, broker or data providers, natural disasters, war or government action.
- We send notices to the email address on your account or in the app. You can send notices to support@fxmind.ai.
- These terms are available in English, Portuguese and Spanish. Where the versions differ, the English version prevails, to the extent the law allows.
